对我国刑事拘留期限问题的思考

摘要。我国现行法律规定了公安机关执行刑事拘留强制措施的若干问题，但是由于现行立法的不完善，侦查人员法治观念的淡薄，以及缺乏有效的监督制约机制等原因，使得公安机关在进行刑事拘留时，存在普遍延长刑事拘留期限、审批程序行政化以及通过其它方式规避刑事拘留期限的问题。因此，必须完善刑事拘留期限的相关立法，提高执法人员的法治意识，建立有效的监督制约机制，设立高效便捷的救济程序，在保障刑事诉讼活动顺利进行的同时，充分的保障犯罪嫌疑人的诉讼权利。

abstract：china'scurrentlawprovidesanumberofissuesofpublicsecurityorganstoenforcethecriminaldetentionofcoercivemeasures，butduetotheimperfectionsofexistinglegislation，theconceptoftheruleoflaw，weakinvestigators，aswellasthelackofeffectivesupervisionmechanism，makingthepublicsecurityorgansincriminaldetentionduringthetime，extendtheperiodofwidespreadcriminaldetention，thechiefoftheapprovalprocessaswellasthroughotherwaystocircumventtheproblemofcriminaldetentionperiod.therefore，wemustimprovetherelevantlegislationincriminaldetention，andtoraiseawarenessoflawenforcementofficers，toestablishaneffectivemechanismofsupervision，theestablishmentofefficientandconvenientreliefprograms，whileensuringthesmoothconductofcriminalproceedings，thefullprotectionoftherightsofcriminalsuspectslawsuit.
